Terms of Service

General

Viewy Real Estate website (“Websites”) and mobile application (“App”) and related services (together with the Websites, the “Service”) are operated by MissionFox Pty Ltd, ACN 76 601 184 963 (“Viewy Real Estate,” “us,” or “we”). Access and use of the Service are subject to the following Terms and Conditions of Service (“Terms and Conditions”). By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions, including any future modifications. Viewy Real Estate may amend, update, or change these Terms and Conditions. If we do this, we will post a notice that we have made changes to these Terms and Conditions on the Website and App for at least 7 days after the changes are posted and will indicate at the bottom of the Terms and Conditions the date these terms were last revised. Any revisions to these Terms and Conditions will become effective the earlier of (i) the end of such 7-day period or (ii) the first time you access or use the Service after such changes. If you do not agree to abide by these Terms and Conditions, you are not authorized to use, access, or participate in the Service.

Real Estate Reports

In addition to the property data available on the Service, Viewy Real Estate offers real estate reports for a fee. These reports provide detailed insights on properties and market trends. By purchasing a report, you acknowledge and agree that while we strive to provide the most accurate and up-to-date information, Viewy Real Estate cannot guarantee the accuracy, completeness, or reliability of the data provided in the reports. The data may be subject to change or errors, and should not be relied upon as the sole source of information for decision-making.

Property reports are provided for general informational purposes only and should not be construed as professional advice. We strongly encourage users to seek professional advice before making any property-related decisions.

 

Description of Website and Service

The Service allows users to access publicly available property data, including but not limited to Property address, Bedroom, Bathroom, Property Size, Pool, and Solar amenities. Viewy Real Estate may, in its sole discretion and at any time, update, change, suspend, make improvements to, or discontinue any aspect of the Service, temporarily or permanently.

 

Voice Services and Data Collection

When using our voice service feature, we may collect audio recordings and transcriptions of your voice interactions. These recordings are used solely to process your requests, such as identifying property addresses, responding to inquiries about mortgage services, and providing real estate connections. We do not retain voice data longer than necessary to fulfil these purposes unless required by law.

The data collected from voice interactions will be treated with the same level of security and privacy as other personal information we collect.

Cross-Border Data Transfers

As we operate in both Australia and Singapore, your personal information may be transferred and stored across borders. We ensure that all such transfers comply with Australian and Singaporean data protection laws, and we handle your information securely and in accordance with this Privacy Policy.

Platform Usage and Restrictions

In accessing or using the Service, you agree that you will not:

  • (a) use any automated device, software, process, or means to access, retrieve, scrape, or index the Service or any content on our Websites;

  • (b) use any device, software, process, or means to interfere or attempt to interfere with the proper working of our Websites;

  • (c) undertake any action that will impose a burden or make excessive traffic demands on our infrastructure that we deem, in our sole discretion, to be unreasonable or disproportionate site usage;

  • (d) use or index any content or data on our Service for purposes of:

    • (i) constructing or populating a searchable database of properties;

    • (ii) building a database of property information;

    • (iii) constructing or populating a property data or property insights product;

  • (e) transmit spam, chain letters, contests, junk email, surveys, or other mass messaging, whether commercial in nature or not;

  • (f) use the Service or any content from the Service in any manner which is, in our sole discretion, not reasonable or not for the purpose which it is made available;

  • (g) violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;

  • (h) pose as any person or entity or attempt to solicit money, passwords, or personal information from any person;

  • (i) act in violation of any Term of Use or other condition imposed by us or any applicable law;

  • (j) reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit the Service or any content on our Websites, except as expressly authorized by us;

  • (k) transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses, or other items of a destructive nature.

 

Third-Party Links and Content

The Service may contain content provided by third parties. These third-party content providers are solely responsible for the accuracy, reliability, and legality of their content. Viewy Real Estate does not endorse or assume any responsibility for any such third-party content, and users should make their own inquiries before relying on it.

 

Indemnification

You agree to defend, indemnify, and hold harmless Viewy Real Estate and its directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns, from and against any and all losses, claims, causes of action, obligations, liabilities, and damages whatsoever, including attorneys' fees, arising out of or relating to your access or use of the Service, your breach of any of these Terms and Conditions, or any claim related to third-party content you submit.

 

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, NEITHER PARTY SHALL BE LIABLE TO THE OTHER PARTY, OR ANY THIRD PARTY CLAIMING THROUGH YOU, FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF CUSTOMERS, LOSS OF CAPITAL, DOWNTIME COSTS, LOSS OF DATA, LOSS OF USE OF DATA, OR LOSS OF ANTICIPATED SAVINGS OR BENEFITS SUFFERED OR INCURRED BY OR AWARDED AGAINST THEM UNDER OR IN ANY WAY CONNECTED WITH THIS AGREEMENT OR THE SERVICE, EXCEPT WHERE SUCH DAMAGES, LOSS OR COSTS:

  • (a) arise from that party’s fraud, criminal conduct, or willful misconduct, or

  • (b) are the subject of an indemnity provided under these Terms of Use.

The aggregate liability of each party and their related entities for loss, damages, and costs that are not excluded under the above clause will be limited to $100.00, except where such damages, loss, or costs:

  • (a) arise from that party’s fraud, criminal conduct, or willful misconduct, or

  • (b) are the subject of an indemnity provided under these Terms of Use.

Jurisdiction

These Terms and Conditions, and all matters relating to your use of the Service, will be governed by the laws of Victoria, Australia. By using the Service, you irrevocably submit to the jurisdiction of the courts of Victoria, Australia, for the resolution of any disputes.
